AGREEMENT TERMS AND CONDITIONS

These terms and conditions are part of the Enrolment Agreement between you and Misha Frankel trading as Connecting Energies (“Connecting Energies”) and apply to the Program, Course or Mentoring Package for your enrolment. This is to the exclusion of all other terms and conditions issued or stipulated by anyone other than Connecting Energies.

1) CANCELLATION OF ENROLMENT

A. Within The Cooling-off Period (3 days)

¨ If you cancel your Enrolment within 3 days of completing this form, we will cancel your enrolment in any Programs or Mentoring Packages and refund you the total amount you have paid to us less any cancellation costs.

¨ All requests to cancel your Enrolments must be received by us in writing, by email to misha@newenergyrising.com.au. Allow 10 business days after a refund has been approved for it to be processed.

¨ If you have enrolled in a digital Course, and that has been delivered, then there is no cooling-off period offered, and no refund is available.

B. After The Cooling-off Period
¨ All Payments paid in accordance with these Terms are non-refundable after the cooling off period.
¨ If you cancel your Enrolment after the 3-day cooling-off period, you may be eligible to receive a credit. Not all programs are eligible for cancellation credits. Credits may not be claimed as refunds; but may be applied towards an enrolment in any Program offered by Connecting Energies within 18 months. You can also transfer your credit to another person. Some programs have eligibility and application criteria, and these must be met for any transferred enrolments.
¨ The credit will be for the total amount you have paid to us less any cancellation costs and a $250 cancellation fee.

C. Cancellation Costs
¨ If you have completed or used any components of your Enrolment, then the cost of this component at its full retail value will be deducted from any refund or credit you are eligible for. This includes all product, programs, coaching, mentoring, events, digital courses, and other bonus items that you have received as these are non-returnable and non-refundable.

2) RESCHEDULING

¨ You may reschedule your Enrolment for no charge if you provide at least 7 days’ written notice before the Program start date. If it is less than 7 days before the Program starts, we charge a $250 Late Transfer Fee to reschedule your enrolment. All requests to reschedule must be received by us in writing, by email to misha@newenergyrising.com.au.

¨ You may reschedule your 1-1 Mentoring session for no charge if you provide at least 24 hours written notice before the Session start time. If it is less than 24 hours before the Session starts, we may charge a $50 Late Transfer Fee to reschedule your enrolment, or else the Session is forfeit. All requests to reschedule must be received by us in writing, by email to misha@newenergyrising.com.au.

¨ If you do not attend a Program, Session or other service you are enrolled in and provide no written request to reschedule then you will forfeit the full cost of that Program and a credit is not available.

¨ Any reschedule is subject to seats being available in another Program. You agree that we may not run the same Program again and there is no obligation on us to do so.

¨ All Enrolments must be completed within 18 months from the original date of the agreement. There will be no credit for Programs not completed within this time, including rescheduled enrolments.

¨ If we make any Program Changes – including change any seminar or phone call dates, venue, city, speaker, content, title, delivery format, or hours – we may do so by notifying you of the changes we make. There is no refund available under any of these circumstances, yet we will waive any cancellation or rescheduling fees that would otherwise apply.

3) PAYMENTS

A. Payments Must Be Complete Before Attendance
¨ All payment plans must be completed on time in order for you to attend and participate in any Programs. For any single Session or Event you must have fully paid the value of that Session or Event before you can attend.
¨ For ongoing Programs with multiple sessions your payment plan must be paid on time and if it is not up to date then you will not be allowed to attend the next session in the Program. You must finalise all payments to attend the final in-person event or complete any certification.
¨ Program privileges including memberships, media, websites, community groups, replays, and other assets may be revoked, disabled, or withheld as we deem appropriate if payments are not made on time.

B. Payment Plan Administration
¨ We will setup your payment plan via credit card and this will be processed by us automatically as scheduled.
¨ All requests to change your payment plan must be received in writing 3 days prior to your scheduled debit date. It is your responsibility to advise us, and refunds will not be given due to your failure to notify us within this time frame.

C. Discounts

¨ If you pay in full when you enrol or within 5 days of enrolling, or any other agreed timeframe nominated as a term of your enrolment, then you are eligible for an extra discount on your enrolment – otherwise you are not eligible for this discount. If your Enrolment includes any other discount (eg. Partner, teen, referral) the discount conditions must be met for it to apply.

4) GENERAL LEGAL COMPONENTS

A.     Disclaimer
¨    Information presented during this Program may at times be prepared and presented by a representative independently of Connecting Energies. We make no representation and give no warranty to the accuracy or completeness of the information provided at or in relation to this Program and do not accept responsibility for any errors or inaccuracies in, or omissions from, this information.
¨    The information provided during or in relation to the Program is for general purposes only and it does not purport to be comprehensive or to render specific advice – it should not be regarded as financial, legal, medical or psychological advice. If any information or advice that may constitute financial, legal, medical or psychological advice is given at or in relation to an event, such advice is not authorised or endorsed by Connecting Energies. This disclaimer does not purport to exclude any warranties implied by law which may not be lawfully excluded.

B.     Personal Responsibility & Health Acknowledgement
¨   The Program may involve meditation, transformational practices, and deep self-exploration, which for some people, can be emotionally and mentally intense. Especially for those with a trauma history, there may be physically intense sensations. While these experiences are designed to be supportive, you acknowledge that they may bring up mental thoughts, physical sensations or emotional responses and you may require integration support afterwards.
¨   You confirm that you are responsible for your own well-being and:
a.      You will listen to your body, your energy and participate at a level that feels safe for you.
b.      You know of no medical or psychological conditions that prevent you from safely participating.
c.      You have consulted a qualified medical professional about any specific health concerns.
d.      You know that this Program is not intended as a substitute for counselling, psychological or psychiatric care

C. Force Majeure
¨ If the Program as contemplated by this Agreement is prevented or cancelled because of an act of God, an inevitable accident, pandemic, fire, blackout, flood or any other calamity, injury, illness or unavoidable cause, or if by reason of strikes, lockouts, government regulations or any other events beyond the direct control of the parties, then Connecting Energies may at its sole discretion choose to: 1) postpone the Services from the original dates to new dates or, 2) cancel the Program and issue a credit, refund or combination of these, as per clause 1.

D. Intellectual Property
¨ All material relating to the Program/s including bonuses, whether presented during, before or after the Program, is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used, or reproduced, without the written permission of the copyright owner.

E.     Media Release
¨   Sessions may be filmed, photographed, and recorded for use in commercial, promotional, and other media purposes. By signing this waiver, I grant Connecting Energies full, unrestricted rights to use my image, voice, and likeness in any format without limitation.
¨   Participation in the program constitutes consent to be recorded. Recordings may be used without further approval or compensation in promotional materials, online content, commercial productions, and any future projects.
¨   Personal and confidential details would not be shared beyond the Program community, yet anything disclosed in Group Sessions will be recorded and replays may be shared with other Clients and Program participants, now and in the future.

F.     Confidentiality
¨    We respect your privacy and will not share your personal or proprietary information with external parties or program participants, beyond what you choose to share in Group Sessions or Community Groups.
¨    We request you respect the privacy of fellow participants and agree not to disclose proprietary information, ideas, plans and trade secrets that are disclosed by other Participants, nor to violate the publicity, privacy. or intellectual property rights of any Program participant.

G.    Non-Disparagement
¨    You agree that you will not make any oral or written statement about Connecting Energies or any of the participants which is intended or reasonably likely to disparage the other party or otherwise degrade the other party’s reputation.
¨    Any conflict, tension, feedback, disagreement or concern should be raised with Connecting Energies directly in a respectful and direct manner, so that resolution and clarity to the concern may be found whenever possible.
¨    This commitment continues after the end of the Agreement term in perpetuity and includes all statements directly or indirectly, and to any action which may, directly or indirectly, disparage or be damaging to the other party (including their agents, affiliates, or partners).

H. Data Security
¨ While Connecting Energies will use its best efforts to ensure that any of your information or data is being backed-up or stored securely, Connecting Energies will not be liable for any unauthorised use, destruction, loss, damage, or alteration to your data, including due to hacking, malware, ransomware, viruses, or other forms of interference.

I. General
¨ The laws of New South Wales govern this agreement. Should any part of this agreement be determined to be invalid or unenforceable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of a member or director of Connecting Energies. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. For such terms, conditions and warranties implied by statute that are not excludable, our liability for breach of such conditions and warranties is limited to the total amount paid by you to Connecting Energies.

General Website Usage and Conditions of Sale - Misha Frankel Connecting Energies

Article 1: Scope of application

These general conditions of sale apply to all transactions concluded through the websites of the Misha Frankel Connecting Energies network. Is considered as "client" any natural or legal person making with Misha Frankel Connecting Energies an order validated via our secure payment platform, or by check or cash.

Article 1a: Age limit

Age restrictions apply: Misha Frankel Connecting Energies only accepts clients over 16 years old (for physical and electronic products) and over 18 years old (for services: coaching, workshops, seminars). We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world. Any subscriber to the newsletter who does not meet these criteria (age over 16) will be immediately deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be immediately reimbursed and a return of the product (s) concerned will be required.

Article 2: Order

Any order placed on a site belonging to Misha Frankel Connecting Energies implies full and unreserved acceptance of these general conditions of sale.

Article 3: Price

The prices are indicated in Australian dollars all taxes included (when applicable), excluding shipping and processing of your order. The price of items can be changed at any time. However, the price applied to an order will be that announced at the time of the order.

Article 4: Payment

Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card. Cards issued by banks domiciled outside Australia must be international bank cards (Mastercard or Visa). We do not accept American Express. Secure online payment by credit card is made through the company Stripe. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.

Article 5: Delivery

Delivery is made to the address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter and especially the postal code). The risks will be your responsibility from the date on which the ordered products have left our premises. However, in the event of a lost package, we will do everything necessary so that you still receive your product or that you are reimbursed according to your warranty.

Article 6: Protection of personal data

In accordance with Data Protection legislation, you have the right to access and rectify personal data concerning you. We declare all of our files to any relevant data protection authorities. By adhering to these general conditions of sale, you acknowledge having read our personal data protection policy and consent to our collection and use of this data. By entering your email address on one of our network sites, you will receive emails containing information and / or promotional offers concerning products published by Misha Frankel Connecting Energies or by other partners. You can unsubscribe at any time. You just have to click on the link at the end of our emails. Article 10: Applicable law All the clauses appearing in the present general conditions of sale, as well as all the operations of purchase and sale which are referred to therein, will be subject to the law of New South Wales, Australia.
